High Court has stayed the notification of the Services Selection Board for various posts in the Health & Medical Education Department.
The advertisement notice came to be challenged by the petitioners on the ground that the posts which have been advertised are being held by them and they are working on these posts and their regularization is under consideration with the Government.
The petitioners after competing in the selection process came to be appointed on these posts in the year 2011 and 2012 on various posts which are technical in nature and are still holding these posts and their case as per the petitioners is pending consideration before the Government.
They argued that their regularization is pending final decision before the Government and the H&ME authorities without taking final call on the issue are trying to fill up the posts in question and ousting the petitioners in order to frustrate their rights.
Since the court has already directed for maintaining the status quo with regard to the posts of petitioners which is still in force and advertisement of these posts is contempt of court in nature.
Court after perusal of the order passed in earlier petitions, said the petitioners have succeeded in obtaining the interim order, directing the status quo with regard to service conditions of the petitioners, direction to allow the petitioners to continue in present position and directed the advertisement notification shall not be acted upon.
In the advertisement notification 52 posts are for General Administration Department, 1444 posts for H&ME department, 256 posts for cooperative department, 4 posts for Floriculture department, 21 posts for LJ&PA department, 6 posts for Skill development department have been put for advertisement by the SSB.
